SmallWorlds Gift Cards Terms and Conditions

1. Purchase of Gift Card(s). You must be thirteen (13) years of age or older to purchase a Gift Card. You warrant to us that you are such an individual. We may, in our sole discretion, prohibit the sale of a Gift Card for any reason. Gift Card purchase amounts by an individual are limited to no more than $999.99 per day.

2. Overview of the Gift Card. Your Gift Card is issued by SmallWorlds and is usable only at the SmallWorlds website and/or in the SmallWorlds game client. At the time of purchase, your Gift Card has a fixed value denominated in U.S. dollars. No credit card, credit line, overdraft protection or deposit account of any kind is associated with your Gift Card. Unless otherwise required by law, any value associated with your Gift Card is non-refundable and may not be redeemed for cash. We do not pay interest or any other earnings on any value associated with your Gift Card. The value associated with your Card is not insured by the Federal Deposit Insurance Corporation ("FDIC") or any other federal or state agency. Purchases of Gift Cards are final and resale of Gift Cards is strictly prohibited.

3. Gift Card Use. You will be required to register for, and be issued, a SmallWorlds Account and to agree to the terms of this Agreement in order to redeem the value associated with your Gift Card. Upon redemption of your Gift Card, the full value associated with your card will be converted into SmallWorlds Gold, the virtual currency used inside the SmallWorlds website and game client, at the then applicable purchase price. The use and purchase of SmallWorlds Gold at SmallWorlds may be subject to additional terms of use. The Gift Card will be linked to the SmallWorlds Account that the redeeming user is logged into at the time of the redemption.

4. Gift Card Use to Purchase Directly from the Merchant. Once a Gift Card has been linked to a specific SmallWorlds Account, it can be used to directly purchase SmallWorlds Gold from SmallWorlds at a retail location. For clarity, when you purchase SmallWorlds Gold using a Gift Card, the Gift Card will not be loaded (or reloaded) with any new value, but instead it is used solely to enable the retailer to identify which SmallWorlds Account to receive credit for the purchase. The purchase will be made at the then current SmallWorlds pricing for SmallWorlds Gold minus any applicable taxes. The quantity of SmallWorlds Gold purchased will be credited to the SmallWorlds Account that is linked to the Gift Card presented to the retailer at the time of purchase. Unless otherwise required by law or specified by the SmallWorlds, all SmallWorlds Gold purchases associated with your Gift Card are non-refundable and the SmallWorlds Gold purchased may not be redeemed for cash.

5. Lost or Stolen Gift Card. The risk of loss and title of your Gift Card, and its associated value, passes to you upon Gift Card purchase. SmallWorlds shall not be held responsible if your Gift Card is lost, stolen destroyed or used without your permission.

6. Limitation of Liability. SmallWorlds and its successors, agents or assigns make no warranties express or implied, with respect to Gift Cards, including, without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In the event a Gift Card is non-functional, your sole remedy, and our sole liability, shall be the replacement of such Gift Card. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions or limitations may not apply to you and you might have additional rights.
